B. Right to Delete You have the right to request deletion of personal information we have collected from you, subject to certain exceptions.

C. Right to Correct You have the right to request correction of inaccurate personal information maintained by RAPSCO.

D. Right to Opt-Out of Sale or Sharing You have the right to opt-out of the sale or sharing of your personal information to third parties. For purposes of the CCPA/CPRA, “sale” means the disclosure of personal information to a third party for monetary or other valuable consideration, and “sharing” means the disclosure of personal information to a third party for cross-context behavioral advertising.

E. Right to Limit Use and Disclosure of Sensitive Personal Information You have the right to request that RAPSCO limit the use and disclosure of your sensitive personal information to uses necessary to perform the services reasonably expected by an average consumer.

F. Right to Non-Discrimination You have the right not to receive discriminatory treatment by RAPSCO for exercising your privacy rights under the CCPA/CPRA.

G. California Shine the Light Law Pursuant to California Civil Code Section 1798.83, California residents may request information regarding the disclosure of their personal information to third parties for direct marketing purposes. H. Do Not Track Signals California Business & Professions Code Section 22575(b) requires RAPSCO to disclose how we respond to web browser Do Not Track signals. As there is not yet an industry consensus as to how to respond to such signals, we do not currently respond to them, though we may choose to do so in the future.

Exercising Your Rights

To exercise your rights under California law or any other applicable privacy law, please submit a verifiable request to us by either:

Only you, or a person legally authorized to act on your behalf, may make a verifiable request related to your personal information. The verifiable request must:

  • Provide sufficient information to allow us to reasonably verify you are the person about whom we collected personal information (or an authorized representative)
  • Describe your request with sufficient detail to properly understand, evaluate, and respond to it
  • We will respond to verifiable requests within 45 days of receipt. If we require more time, we will inform you of the reason and extension period in writing. RAPSCO primarily operates in the United States and the personal information we collect is governed by U.S. law. CHILDREN’S PRIVACY

The Site is not directed to children under 13 years of age, and RAPSCO does not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. DISPUTE RESOLUTION

JAMS Alternative Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Privacy Policy, including the breach, termination, or validity thereof, shall be finally resolved by arbitration administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and, in cases of international arbitration, the JAMS International Arbitration Rules. The seat of arbitration shall be Riverside, California. The number of arbitrators shall be one. The language of the arbitration shall be English. Plantiff agrees to pay for all fee’s associated with the artbiter and court reporter and transcripts. The transcripts are to be delivered to the respondant within 60 days, Plaintiff is to pay for any and all delivery of said transcripts. Plaintiff also agrees to pay for reasonable parking fee’s for any representative or agent from Raps.co.

You and RAPSCO agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action. Notwithstanding the foregoing, either party may seek equitable relief in any court having jurisdiction to protect its intellectual property or confidential information.

Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you and RAPSCO hereby submit to the personal jurisdiction of such courts.

SEVERABILITY

If any provision of this Privacy Policy is held to be unlawful, void, invalid, or for any reason unenforceable, then that provision shall be deemed severable from this Privacy Policy and shall not affect the validity and enforceability of any remaining provisions. In the event of such severance, the parties shall replace the severed provision with a provision that comes closest to the intention of the parties.

WAIVER

The failure of RAPSCO to enforce any right or provision of this Privacy Policy will not be deemed a waiver of such right or provision. Any waiver of any provision of this Privacy Policy will be effective only if in writing and signed by an authorized representative of RAPSCO.
